Coaching Agreement & Cancellation Policy
By scheduling a coaching session with Kabashinski.com, you are agreeing to the following terms and conditions:
Coaching is a collaborative process with an ongoing relationship between you and the Coach. The coaching experience supports you in establishing new behaviors and/or thought patterns. The coaching relationship is strengths-based, forward-looking, and collaborative. The coaching agenda is developed and implemented in partnership between you and the Coach. The role of the Coach is to help you progress toward achieving one or several goals.
- You and the Coach agree to engage fully in the coaching experience.
- You recognize that coaching is not therapy, counseling, nor consulting.
Confidentiality
The Coach agrees to keep all conversations and information with you private and confidential, as allowable by law. The Coach adheres to maintain your name and information confidential, except with additional Kabashinski.com staff and third party platforms, such as Stripe, Zoom and Google Calendar for administrative and payment purposes.
No personal information will be shared with anyone beyond the above mentioned without your express permission. Exceptions may be made if there is an imminent threat of serious injury to yourself or someone else.
Coaching Commitment
By entering into this relationship, you and the Coach acknowledge that you desire to change a pattern or some type of improvement in your life. Change often takes time to implement and sustain. The pace of change is uncertain and varies amongst individuals.
Coaching Relationship
- Coach agrees to maintain the ethics and standards of behavior established by the National Board for Health and Wellness Coaching “(NBHWC)” (https://nbhwc.org/code-of-ethics/). It is recommended that you review the NBHWC Code of Ethics and the applicable standards of behavior.
- You are solely responsible for creating and implementing your own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and your coaching calls and interactions with the Coach. As such, you agree that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. You understand coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, nor treat any mental disorder or medical disease.
- You acknowledge that coaching is a comprehensive process that may involve different areas of your life, including work, finances, health, relationships, education and recreation. You agree that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively your responsibility.
- You acknowledge that coaching does not involve the diagnosis nor treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is your exclusive responsibility to seek such independent professional guidance as needed. If you are currently under the care of a mental health professional, it is recommended that you promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by you and the Coach.
- You understand that in order to enhance the coaching relationship, you agree to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.
Limited Scope of Service
This engagement is limited to coaching services that you have selected. If you decide to engage Kabashinski.com for additional services, you will be required to sign a new Service Agreement concerning those services.
Limited Liability
Kabashinski.com makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall Kabashinski.com be liable to you for any indirect, consequential or special damages. Notwithstanding any damages that you may incur, Kabashinski.com’s entire liability under this Agreement, and your exclusive remedy, shall be limited to the amount actually paid by you to Kabashinski.com under these terms for all coaching services rendered through and including the termination date.
Coaching Fee
The coaching service is provided at a flat fee, which must be paid in advance and constitutes full payment for coaching service. The coaching fee is fully earned upon receipt, subject to the cancellation and refund policy set forth below. You may cancel this or future coaching sessions for any reason, and we may also cancel the coaching for any reason. You may be entitled to a refund of a portion of the coaching fee if coaching is not provided, subject to the cancellation and refund policy below. Coaching sessions purchased as part of a package must be completed one year from date of purchase. Any unused sessions will be forfeited after one year from the date of purchase.
Cancellations, No-Shows, & Refunds
If you need to cancel or reschedule a coaching session, please do so at least 24 hours in advance. Cancellations with at least 24-hours notice will receive a 75% refund, which you agree is the fee earned by Kabashinski.com for losing the time slot which we would have otherwise been able to book, plus the administrative time to refund and reslot the coaching time. Any coaching that is not started within 10 minutes of the scheduled start time will be considered a no-show, and will be charged 100% of the session fee. Cancellations with less than 24-hours notice are subject to a 100% session fee, which you agree is the fee earned by Kabashinski.com for preparation for the coaching. Because our time is limited, and we receive more requests for coaching sessions and client work than we can fill, no-shows will not receive a refund of the fees paid. You will receive a full refund, or be offered an additional coaching session at no charge, for any coaching sessions that the coach cancels with less than a 24-hours notice. If you purchased a package of sessions and need to cancel within one week of purchasing them, you’ll be refunded any unused sessions, except for sessions not cancelled within 24-hours.
